The general Terms & Conditions of Sale detailed below govern the contractual relationship between the ‘User’ (hereafter also referred to as ‘You’ or the ‘Customer’) and ‘West Country Designs’ (hereafter also referred to as ‘We’, 'Our' or the ‘Website’), belonging to the business West Country Designs. Both parties accept these Conditions unreservedly. These General Conditions of Sale are the only conditions that are applicable and replace all other conditions, except in the case of express, written, prior dispensation. We maintain that, by confirming your order, you have read and do unreservedly accept our General Conditions of Sale. These Terms and Conditions of Sale are important to you and West Country Designs as they are used to protect your rights as a valued customer and our rights as a business.

Product Information

​All West Country Designs products are designed and manufactured in the UK. 

Please be aware that all products may vary slightly in colour and appearance from the images on the website. At West Country Designs we take great care when putting product information, descriptions, and images online but will not be held responsible for any mistakes or omissions to any information given. May also vary due to the organic nature of materials the products are created with and the nature of how colours appear on different electronic screens. You are always welcome to get in touch if you have any further queries or questions relating to any of West Country Designs artworks or products through our contact page. 

Prices

​The prices indicated on West Country Designs website are shown in Pound Sterling. The delivery costs are clearly shown and invoiced at the end of the order in addition to the price of the products. We reserve the right to modify our prices at any moment, but this will be indicated to you on the order at the time the order is placed. If an obviously incorrect price appears on our website and is not corrected on your total at the time of order completion, for whatever reason (human error, technical error etc.), your order will be cancelled and the payment refunded to you, even if it has been initially validated. If ordering multiple items, it is possible to request separate packaging, however, please note this is subject to an additional per item charge.

​ Availability

​Due to the nature of many of the items sold on this website being handmade or ordered in relatively small quantities from local suppliers, shipping times may vary. Please see the delivery section for delivery estimates. If a product should become unavailable after your order has been confirmed and paid for, we will contact you personally immediately and offer to refund the price you paid for the product within 30 days following the date of payment. If your order includes products that are temporarily unavailable, we can offer the option to send the available products out first and will follow with the outstanding items once they are available again. You of course will not be charged shipping fees for the rest of the order. If relevant, we can offer you a replacement for an unavailable product, a product of equal price and quality. If you accept the replacement and then wish to return it to us in the conditions outlined under 'Return & Refunds', the return postage will be covered by us. If you choose to decline this offer, and the original product is permanently unavailable, we will reimburse the price of the unavailable product. Please note if your order is required for an event such as birthday or wedding that will occur within the next 7 days, please contact us prior to ordering to so that we can ensure you will receive your order on time your event.

Secure Payment

​West Country Designs currently offers PayPal as a payment method. This option uses advanced SSL encryption to keep your transaction secure and do not cost you anything to use (West Country Designs is charged as the seller you are not charged as the buyer) so you will not pay any extra for your order. You do not need to hold an account with this Merchant to use these method of payment. Please refer to PayPal for full terms and conditions of use.

Commissions

​Commissioned/bespoke illustrations cannot be returned once they have been completed and paid for.

 Changes to Terms of Service and the Website

​West Country Designs is a work in progress, and as such things may change, be added or be taken away. We reserve the right to update the Website and these Terms of Service from time to time, at our discretion and without any notice. It is solely your responsibility to keep up to date with the latest Terms and Conditions by checking back regularly. Your continued use of the Website following the publishing of updated Terms of Service will be taken to mean that you have read and agree to the changes.

Website Access

​While we endeavour to ensure that our website is normally available 24 hours a day, we will not be liable if for any reason this website is unavailable at any time or for any period. Access to this website may be suspended temporarily and without notice in the case of system failure, maintenance, or repair or for reasons beyond our control.

 Intellectual Ownership

​All the website and social media content at West Country Designs (illustrations, artworks, designs, texts, names, brand names, images, and videos), excluding manufacturer supplied descriptions, illustrations and image is the property of West Country Designs. Any partial or total reproduction of this content, along with any commercial reselling of any products or designs (online and offline), by any means and on any support, is subject to prior and express authorisation by West Country Designs. All information, content and files are protected by International law concerning intellectual ownership and copyright. West Country Designs cannot give you the right to copy, display or distribute content that you do not have the intellectual rights to. All fraudulent use of this content that violates the rights held by a third party constitutes an offence of forgery, which is severely punished under the Intellectual Property Code.

West Country Designs will not, under any circumstances, be held responsible if a user violates rights held by a third party through his activities on the site.
